Lifetime Health Guarantee
While other "responsible" breeders typically offer 2 year health guarantees with little or no real commitment or remedy, Mountain Rose stands by you and your Bordoodle through life! Because the diseases and conditions covered in those "other" health guarantees typically do not manifest themselves until after the age of 4 in most canines, many breeders who want to appear to be "responsible" will offer the "typical" 2 year health guarantee knowing very well that the likelihood of disease manifestation will be rare within the first 2 years of life. Even at that, those guarantees typically offer a remedy that is less than adequate. Mountain Rose, on the contrary, stands by the health of your Bordoodle through life. We are able to do this because we have owned most of our breeding dogs going back multiple generations. We know the history of our parent dogs, grandparents and great grandparents. To further ensure the health of our Bordoodles, we also conduct DNA testing for the presence mutated genes that can cause illness and disease. All or our parent dogs are 100% clear of those "High Risk" genes in which are known to cause the various diseases found in canines and those few that are specific to Border Collies and Poodles. We also conduct testing on hips and joints with all parent dogs through OFA and/or Penn Hip. If our parent dogs don't score in the 80th percentile (or better) on Penn Hip, or "Good to Excellent" on OFA, we will not breed those dogs. Most "good" breeders settle for 60% and "Fair" (that's not bad, but it certainly falls below our standards). Because we have such a great passion for bringing only the healthiest of puppies into this world, we enthusiastically stand by you and your Bordoodle through LIFE.
Definitions: Mountain Rose Inc (Breeder) | Puppy Owner (Buyer)
Hereditary Health: If at any time in the puppy’s life, the puppy is found to have any of the following health issues or hereditary defects, which include Hip Dysplasia, Urinary Bladder Stones, Epilepsy, Heart Disease, Liver or Kidney Disease, Degenerative Myelopathy, Progressive Retinal Atrophy, Osteochondritis Dissecans, Patella Luxation, Hypothyroidism, Collie Eye Anomaly, Addison’s Disease or any other hereditary defect which impacts clinically on the dog’s quality of life, as certified by a qualified veterinarian, (the Breeder has the right to require a second opinion from a nominated veterinarian of Breeder’s choosing at the Breeder’s expense), the REMEDY clause outlined in this Agreement shall be applicable and considered the only remedy/compensation available to the Buyer throughout the lifetime of the dog. This hereditary health statement does not cover or warranty against viral or bacterial illnesses and does not include or cover accidental physical injury, cancer (many types of cancers can be attributed to poor diet, lack of exercise and stress) or any digestive system related illness, which may be caused by the ingestion of foreign objects, chemicals, spoiled food, poor diet or the onset of physical or mental stress.
Nutrition: For the first year of the puppy's life, the Buyer agrees to feed the puppy a high quality grain free puppy food. After the puppy reaches one year of age the Buyer agrees to transition their dog to a high quality adult grain free dog food.
Breeding Rights: It is agreed that the Buyer may not breed the dog (male or female), unless special permission is granted by the Breeder.
Spay/Neuter: The Buyer agrees to spay/neuter the puppy prior to the puppy reaching 1 year of age and proof provided to the breeder within 30 days, unless otherwise agreed. If proof of spaying/neutering is not provided to the Breeder within the specified time, the Buyer agrees to remit a “penalty payment” to the Breeder in the amount of $5,000.00 within 90 days following the puppy's first birthday. If this penalty payment is not received within the allowed time period, the Remedy clause outlined in this Agreement shall become null and void and the Breeder shall retain the right to collect the “penalty payment” by all legal means necessary. The Buyer shall be responsible to pay for any and all collection expenses, including any legal fees and court costs incurred by the Breeder in an effort to collect. This Spay/Neuter clause exists to protect the puppy, the breed integrity and the business interests of the Breeder.
Vaccinations & Veterinary Visits: Prior to delivery of the puppy to the Buyer, the Breeder agrees to provide all core vaccinations per DVM recommendations beginning at 6 weeks of age and continuing with the vaccination protocol of providing additional rounds of vaccinations at 9 weeks, 12 weeks and 15 weeks as may be applicable while in the care of the Breeder. Once the Buyer receives the puppy, the Buyer agrees to continue with the vaccine protocol as may be necessary to finish the initial rounds of vaccines as recommended by DVMs. The Buyer also agrees to keep the puppy up to date on all vaccinations throughout the puppy’s life as recommended by DVMs. The Buyer further agrees to arrange and maintain semi-annual veterinary health exams throughout the lifetime of the dog, and to keep records of all veterinary visits and vaccinations. If for ANY REASON the dog is euthanized or in any way disposed of without a second opinion from the Breeder’s preferred veterinarian, the REMEDY clause of this Agreement shall become null and void.
Remedy: If it becomes necessary to replace a dog or to seek a remedy due to a health problem, the Buyer agrees to choose one of the following remedies.
1) The Breeder will replace a puppy of equal value. When choosing this remedy, the Buyer is required to return the dog to the Breeder at Buyer’s expense. It is understood that there may not be a replacement puppy available at the time of request, therefore the Breeder is given up to 9 months to satisfy this remedy.
2) The Breeder will reimburse the Buyer in the amount of 100% of the original purchase price of the puppy. It is understood that reimbursement is defined as the Breeder giving back to the buyer 100% of the original sale price of the puppy, not including costs of shipping or training. When choosing this remedy, the Buyer is required to return the dog to the Breeder at Buyer’s expense.
Canine Disposition Statement: The Breeder cannot guarantee color, size, temperament or whether the puppy will shed or not shed or be hypoallergenic. These can only be estimated and can always change or differ and are ultimately outside of the Breeder’s control.
Warranty & Conditions: The provisions set forth in this Agreement are the sole warranty and is given in lieu of any and all other warranties, expressed or implied. The Breeder will not be liable for any other damages including consequential damages, property damage, emotional distress, loss of use, business interruption, or veterinary fees unless specifically set forth in this warranty provision. In the unlikely event of a dispute or litigation over the conditions and warranties set forth in this Agreement, legal jurisdiction shall be held in the State of Utah, Box Elder County. Whether a dispute or disagreement over this Agreement takes place within or outside a court of law, Buyer and Breeder agree to not discuss or speak of any disputes or disagreements to anyone other than each other. Neither the Breeder nor the Buyer will discuss or casually talk about any disagreement or dispute publicly on internet forums, blogs, complaint web sites, review web sites, facebook, twitter, emails or any other internet communication medium that allows anyone else other than the Breeder or Buyer to review. Failure to abide by the conditions of this paragraph will result in the REMEDY clause section of this Agreement becoming immediately null and void.
